Frequently Asked Questions

Clear answers to the questions people ask first.

Start with a direct answer, then contact us when you need help applying it to your situation.

What happens when I inherit a house in Georgia?+

You may need to confirm ownership, address probate, and decide whether to sell, keep, or rent the property. Review the mortgage, taxes, insurance, repairs, condition, and family needs.

Do I have to go through probate to inherit a property?+

Often, yes, but not always. Whether probate is required depends on how the property was owned and the estate documents. Coordinate with qualified probate counsel for an answer about your estate.

Should I sell or keep an inherited property?+

There is no single right answer. Compare the property’s value and condition with the mortgage, taxes, insurance, repairs, family needs, and the costs and responsibilities of holding or renting it.

What are surplus funds, and do I qualify?+

Surplus funds are money left after a foreclosure or county tax sale when a property sells for more than the lender, county, or tax authority was owed. You may qualify if you are the former owner or another person with a valid legal interest; records and deadlines matter.

How long do I have to claim surplus funds?+

The deadline depends on the type of sale, the county or government entity, and the applicable Georgia process. Confirm the exact deadline promptly because government entities may keep funds when no action is taken.

What is the first step to stop foreclosure?+

Contact the lender’s loss mitigation department first. Ask for the foreclosure timeline, hardship options, required documents, and a written explanation of what happens next.

If my home goes through the foreclosure process to completion, do I lose ownership and have to move out?+

Yes. When foreclosure is completed, you lose ownership of the home and must vacate it. The exact timing and move-out requirements can vary, so get advice about your notice and situation promptly.

Do lenders always begin foreclosure after I miss a payment?+

Not immediately. Most lenders start the foreclosure process after about three to six consecutive missed payments, but timing varies by lender, loan documents, and circumstances.

What should I do if I am having difficulty paying my mortgage?+

Contact your lender or loan servicer first and ask about hardship and loss-mitigation options. If that is not helpful, contact REI Help Center, HUD, Georgia Legal Aid, or USA.gov for additional guidance and resources.

Can I avoid foreclosure or stay in my home in some situations?+

Sometimes, yes. Options may exist depending on your situation, lender policies, and how early you seek help. Start by understanding your timeline and asking the lender about every available option.

Will bankruptcy stop foreclosure?+

Bankruptcy may trigger an automatic stay, and Chapter 13 may create a 3–5 year repayment plan, but the result depends on the case and timing. Speak with a qualified bankruptcy lawyer before relying on it.

Do I need a lawyer?+

REI Help Center is not a law firm and does not provide legal advice. You may need a lawyer for probate, bankruptcy, title, foreclosure litigation, or a dispute over funds. We can help you understand questions to bring to the right professional.
